1. Eligibility; Service Access

  3. Entity Accounts. If you are using or opening an Account through the Service on behalf of a company, entity, or organization (a “Subscribing Organization”), then you represent and warrant that you are an authorized representative of that Subscribing Organization with the authority to bind such organization to these Terms; and agree to be bound by these Terms on behalf of such Subscribing Organization.
  4. Account Security. You agree that the information you provide to casecamp.com on registration and at all other times will be true, accurate, current, and complete. You also agree that you will ensure that this information is kept accurate and up-to-date at all times. When you register, you will be asked to create a password. As you will be responsible for all activities that occur under your Account, you should keep your password confidential. You are solely responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities

casecamp.com reserves the right to remove Content alleged to be infringing without prior notice to you and at its sole discretion. WE WILL NOT SELL, LICENSE, DISTRIBUTE, COPY, MODIFY, DISPLAY, TRANSMIT, PUBLISH, EDIT, ADAPT, CREATE DERIVATIVE WORKS FROM, OR OTHERWISE MAKE UNAUTHORIZED USE OF YOUR MATERIALS.
  3. Ownership Rights. casecamp.com OWNS THE RIGHTS TO NAMES, LOGOS AND LEGAL ENTITIES CREATED FOR THE PURPOSE OF USING THE casecamp.com NETWORK. casecamp.com RESERVES THE RIGHT TO SELL AND OR TRANSFER OWNERSHIP OF SUCH NAMES, LOGOS AND OTHER GROUP IDENTIFYING INSIGNIA AT ITS SOLE DISCRETION IT DEEMS APPROPRIATE.
    IV. Content Removal. casecamp.com reserves the right to not post or publish any materials, and to remove or edit any material, at any time in its sole discretion without notice or liability. casecamp.com has the right, but not the obligation, to monitor any materials submitted by you or otherwise available on the Service, to investigate any reported or apparent violation of these Terms, and to take any action that casecamp.com in its sole discretion deems appropriate, including, without limitation, termination here under.

14.Objectionable Material.

You understand that by subscribing to the Site you may encounter material that you may deem to be offensive, indecent, or objectionable, and that such content may or may not be identified as having explicit material. 15.Termination

  3. Survival. Sections 4.2, 6.4 through 6.7, 6.10, and 18 though 28 will survive any termination of these Terms.

20.User Disagreements

You alone are responsible for your involvement with other users. casecamp.com reserves the right, but has no obligation, to monitor disagreements between you and other users. If you have a dispute with one or more users, you irrevocably and forever release casecamp.com (and casecamp.com ‘s users, officers, directors, agents, subsidiaries, joint ventures, and employees) from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

22.Indemnification; Hold Harmless

23.Waiver

The failure of any party at any time to require performance of any provision of these Terms will in no manner affect such party’s right at a later time to enforce the same. A waiver of any breach of any provision of these Terms will not be construed as a continuing waiver of other breaches of the same or other provisions of these Terms.

24.Limitation of Liability and Damages

IN NO EVENT WILL casecamp.com , THE PROVIDERS OR casecamp.com ‘S AFFILIATES, VENDORS, EMPLOYEES, AGENTS, OR THIRD-PARTY PARTNERS OR SUPPLIERS HAVE ANY LIABILITY TO YOU FOR DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE OR THE SERVICE (WHETHER IN CONTRACT, TORT INCLUDING NEGLIGENCE, WARRANTY, OR OTHERWISE).

25.Digital Millennium Copyright Act Compliance (DMCA)

  1. 26. Dispute Resolution

These Terms shall be governed in all respects by the laws of the State of California as they apply to agreements entered into and to be performed entirely within California between California residents, without regard to conflict of law provisions. You agree that any claim or dispute you may have against casecamp.com and/or the users must be resolved by a court located in Dallas, TX, except as otherwise agreed by the parties or as described in the Arbitration Option paragraph below. You agree to submit to the personal jurisdiction of the courts located within Dallas, TX for the purpose of litigating all such claims or disputes.
  3. Mandatory Arbitration. For any dispute you have with casecamp.com , you agree to first contact casecamp.com at support@casecamp.com .com to attempt to resolve the dispute with casecamp.com informally. In the unlikely event that casecamp.com has not been able to resolve a dispute it has with you after attempting to do so informally, casecamp.com and you each agree to resolve any claim, dispute, or controversy (excluding claims for injunctive or other equitable relief) arising out of or in connection with or relating to this Agreement, or the breach or alleged breach thereof (collectively, “Claims”), by binding arbitration by the American Arbitration Association (“AAA”) under the Commercial Arbitration Rules and Supplementary Procedures for Consumer Related Disputes then in effect for the AAA, except as provided herein. Unless you and casecamp.com agree otherwise, the arbitration will be conducted in Dallas, Texas. Each party will be responsible for paying any AAA filing, administrative and arbitrator fees in accordance with AAA rules. The award rendered by the arbitrator shall include costs of arbitration, reasonable attorneys’ fees and reasonable costs for expert and other witnesses, and any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Nothing in this Section shall prevent either party from seeking injunctive or other equitable relief from the courts for matters related to data security, intellectual property or unauthorized access to the Service. ALL CLAIMS MUST BE BROUGHT IN THE PARTIES’ INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING, AND, UNLESS casecamp.com IN ITS SOLE DISCRETION AGREES OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS. YOU AGREE THAT, BY ENTERING INTO THIS AGREEMENT, YOU AND casecamp.com ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

27.Miscellaneous

  1. Severability. If any provision of these Terms shall be invalid, unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provisions.
  2. Assignment. These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you but may be assigned by casecamp.com without restriction.
  3. Headings. The heading references herein are for convenience purposes only, do not constitute a part of these Terms, and will not be deemed to limit or affect any of the provisions hereof.

  4. IV. Entire Agreement. These Terms, together with any other provisions incorporated hereunder by reference, as they may change from time to time in accordance with the terms herein, are the entire agreement between you and casecamp.com and the users relating to the subject matter herein and will not be modified except in writing, signed by both parties, or by a change to these Terms or Guidelines made by casecamp.com as set forth in Sections 12 and 13 above. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content, or third-party software.

  5. Claims. YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE MUST COMMENCE WITHIN ONE (1) MONTH AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED. Disclosures. The Services hereunder are offered by casecamp.com , email: support@casecamp.com .com.
  6. Enforcement. casecamp.com reserves the right to take steps casecamp.com believes are reasonably necessary or appropriate to enforce and/or verify compliance with any part of these Terms. You agree that casecamp.com has the right, without liability to you, to disclose any registration data and/or Account information to law enforcement authorities, government officials, and/or a third party, as casecamp.com believes is reasonably necessary or appropriate to enforce and/or verify compliance with any part of these Terms (including but not limited to casecamp.com ‘s right to cooperate with any legal process relating to your use of the Site and/or Service and/or other products, and/or a third-party claim that your use of the Service and/or other products is unlawful and/or infringes such third party’s rights).
  7. Electronic Submissions. Your use of the Services includes the ability to enter into agreements and/or to make transactions electronically. YOU ACKNOWLEDGE THAT YOUR ELECTRONIC SUBMISSIONS CONSTITUTE YOUR AGREEMENT AND INTENT TO BE BOUND BY AND TO PAY FOR SUCH AGREEMENTS AND TRANSACTIONS. YOUR AGREEMENT AND INTENT TO BE BOUND BY ELECTRONIC SUBMISSIONS APPLIES TO ALL RECORDS RELATING TO ALL TRANSACTIONS YOU ENTER INTO ON THE SITE, INCLUDING NOTICES OF CANCELLATION, POLICIES, CONTRACTS, AND APPLICATIONS. In order to access and retain your electronic records, you may be required to have certain hardware and software, which are your sole responsibility.
